Sometimes Nero Burns at 2.4x unless I turn off then it always burns 4x why?

I've got a funky issue. When I start Nero it will sometimes want to set the max burn to only 2.4x, however if I turn off the computer and turn it back on it will ALWAYS give me the option to burn at 4x. Is there a way I can fix it so I dont need to power my pc off everytime i want to burn at 4x. Windows XP SP1, Nero 5.5.10.45 Bundled with my Magic Spin BDVDRW8D 8x DVD-/+ R/RW. Any info would be appreciated.

Have you tried simply opening the tray, removing the burnable DVD, closing the tray, re-opening, and re-inserting the burnable DVD?

I'll try this the next time it flukes out to 2.4x and see if that works
